Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the SpeakClearly mobile application (the "Service") operated by SpeakClearly ("us", "we", or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
SpeakClearly provides a speech therapy practice and improvement application that offers various exercises and features designed to help users practice and improve their speech clarity, intonation, rhythm, word stress, and other aspects of spoken communication.
The Service is intended as a supplementary practice tool and is not a replacement for professional speech therapy or medical advice. Always consult with a qualified speech-language pathologist or healthcare provider regarding your specific condition and therapeutic needs.
When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
The Service and its original content, features, and functionality are and will remain the exclusive property of SpeakClearly and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.
Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of SpeakClearly.
Our Service may allow you to record, store, and share certain content such as voice recordings, performance data, and other information ("User Content").
You retain any and all of your rights to any User Content you submit, post, or display on or through the Service and you are responsible for protecting those rights.
You represent and warrant that your User Content does not violate third-party rights of any kind, including without limitation any intellectual property rights or privacy rights.
We collect and process personal data as outlined in our Privacy Policy. By using our Service, you agree to our collection and use of information in accordance with our Privacy Policy.
When you use our speech recognition features, your voice data may be processed to provide analysis, feedback, and improvement suggestions. We take precautions to protect your voice data and other personal information in accordance with our Privacy Policy.
Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring basis, depending on the type of subscription plan you select.
At the end of each billing period, your subscription will automatically renew under the exact same conditions unless you cancel it or we cancel it.
You may cancel your subscription either through your online account management or by contacting our customer support team. You will not receive a refund for the fees you already paid for your current subscription period, and you will continue to have access to the Service through the end of your current subscription period.
We may, at our sole discretion, offer a subscription with a free trial for a limited period of time.
You may be required to enter your billing information to sign up for the free trial.
If you do not cancel before the free trial period ends, we will automatically charge the subscription fee for the type of subscription you selected.
We reserve the right to withdraw or amend our Service, and any service or material we provide via the Service, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Service is unavailable at any time or for any period.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.
In no event shall SpeakClearly, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.
NOT A MEDICAL DEVICE: SpeakClearly is a software application designed for speech practice and is not a medical device as defined by the U.S. Food and Drug Administration or equivalent regulatory bodies in other jurisdictions. The application has not been evaluated by the FDA or any regulatory authority for safety or efficacy.
NO MEDICAL CLAIMS: SpeakClearly makes no claims regarding the diagnosis, treatment, mitigation, cure, or prevention of any disease, disorder, or medical condition. The application is not intended to diagnose, treat, cure, or prevent any disease, speech disorder, or medical condition.
NOT A SUBSTITUTE FOR PROFESSIONAL CARE: SpeakClearly is not a substitute for professional medical advice, diagnosis, or treatment. The exercises, feedback, suggestions, and information provided within the application are for general informational and practice purposes only and should never be used as a replacement for consultation with qualified healthcare providers, including but not limited to speech-language pathologists, physicians, or other medical professionals.
NO PROFESSIONAL RELATIONSHIP: Use of SpeakClearly does not create a doctor-patient relationship, therapist-client relationship, or any other professional healthcare relationship. Always seek the advice of your physician, speech-language pathologist, or other qualified healthcare provider with any questions you may have regarding a medical condition or speech disorder.
INDIVIDUAL RESULTS MAY VARY: Speech improvement outcomes vary from person to person. No guarantees or warranties are made regarding the effectiveness of the application for any individual user's specific circumstances, conditions, or goals.
EMERGENCY SITUATIONS: SpeakClearly is not designed for emergency situations. In case of a medical emergency, contact emergency services immediately.
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied.
SpeakClearly, its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements or lead to specific speech improvement outcomes.
These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
